- 摘要：
集体土地发展权是影响乡村土地利用变迁和开发收益分配的关键。实际上，集体土地 发展权的“赋予”与“行使”在“一致”和“偏离”之间摇摆，这种张力受到政策制度、 组织理念、资源等结构性要素及相关主体利益博弈的共同影响，最终作用于乡村建设 空间。文章构建了“结构—参与者”→“集体土地发展权”→“空间变迁”的解释框架， 以北京市 D 村为例进行实证研究。研究发现，在 D 村建设用地“增量扩张”“增征并存”“减量发展”的 3 大阶段中，随着发展理念、政策制度、资源等结构性要素不断变化，政府、 村集体、企业等参与者关系经历了“增长联盟”—“竞合博弈”—“被动服从”的互动演进， 并导致不同阶段集体土地发展权赋予与行使的“偏合”，推动了乡村建设用地变迁。 - 关键词：
乡村建设用地；集体土地发展权；赋予和行使；结构—参与者；北京； - Abstract: Collective land development rights are the key factors that affect rural land use change and benefit distribution. In fact, the “grant” and “practice” of collective land development rights always swings between “consistency” and “deviation”. This tension is influenced by policy system, organizational concept, resources and other structural elements as well as the interests of stakeholders, and ultimately affects the rural construction space. This paper develops a framework of “structure-agency”—“collective land development rights”—“spatial transformation”, and takes D village in Beijing as an example. It was found that the change of construction land in D village experienced three stages, namely the periods of “incremental expansion”, “levy simultaneously”, “reducing development”. As the structural elements changed, the relationship between local governments, village collectives and enterprises transformed accordingly, from a “growth alliance” to “competition and cooperation game” and further to “passive obedience”. Finally, it led to the differentiated tension between “de jure” and “de facto” collective land development rights, and then influenced the change of rural construction land.
