地下空间利用立法与管理问题的核心是对
“地下空间权”以及“相邻关系”的处理。通
过立法确立“地下空间权”，体现公平最大化
原则，可以从法理上占据主动。但现行体制
下对产权复杂的空间领域的管理仍然是难点，
有待研究。 - 关键词：
地下空间；立法；管理； - Abstract: How to deal with the“underground
space rights” and “the neighborhoods” is the key
to the problem of the legislation and management
of underground space. We can establish
“underground space rights”by legislation to
maximize the equity, so that taking the initiative
in nomology. But there’s still some difficulty
when it comes to the management of the
complex space property rights under existing
system and the problem need lucubrating.
